Preamble

We, the Citizens of Sky Haven, in order to establish a democratic government, its powers, and the rights of the people, hereby enact this document as our fundamental law, which no other law shall supersede.

The Demiurge

Identity

TD-I. The founder SkyGreen24 shall be known as the Demiurge.
(I) The Demiurge's NationStates nation is Brox Reple.

Powers

TD-II. The Demiurge shall hold the founder powers of Sky Haven and may use them as they see fit to provide peace and stability to the region.
TD-III. The Demiurge, or their designated Deputy, may grant the status of citizenship to any resident and may remove citizen status as they wish.
TD-IV. The Demiurge may dissolve the Government and create their own at their discretion.
TD-V. The Demiurge, or their designated Deputy, shall administer all elections within Sky Haven.
TD-VI. The Demiurge, or their designated Deputy, shall be explicitly empowered to moderate and administrate all official regional communication platforms as befits an Administrator of an internet platform regardless of implications in in-game terms.

The Government

TG-I. In the interest of forming a stable regional authority, a government consisting of three branches shall be established in Sky Haven:
(a) The Domus, which shall hold Executive Authority;
(b) The Lawgrove, which shall hold Legislative Authority;
(c) The Magistrates, which shall hold Judicial Authority.
TG-II. All officers of the Government must be citizens of Sky Haven.

Domus

The Majordomo

DM-I. The Majordomo shall be the Chief Executive of the region and run the day-to-day operations of the region along with their Magnadomo, the Vice Executive, and the Minordomos, the Cabinet.
DM-II. The position of Majordomo shall be up for election every sixty (60) days on a ticket with the Magnadomo.
DM-III. In the event of a vacancy for reasons other than the expiration of the term in the position of Majordomo, the Magnadomo shall resign and assume the position of Majordomo for the rest of the term.
DM-IV. In the event of a vacancy for reasons other than the expiration of the term in the position of Magnadomo, the Majordomo shall appoint a Magnadomo subject to Lawgrove approval through a simple majority vote.

Duties of the Majordomo

DM-V. The Majordomo shall be the Chief Domestic Officer of Sky Haven, with discretion over the employment and integration of citizens of the region and cultural apparatuses.
DM-VI. The Majordomo shall be the Chief Diplomat, with discretion over relations with other regions and in-game embassies.
DM-VII. The Majordomo shall be the Commander-in-Chief, with discretion over the deployment of the regional military.
(I) The Majordomo may issue declarations of war that shall not go into effect until approved by the Lawgrove by a two-thirds majority vote.

Powers of the Majordomo

DM-VIII. The Majordomo may appoint Minordomos with the approval of the Lawgrove through a simple majority vote.

Lawgrove

Legislative Assembly

LG-I. To establish a legislative body in which the people of this region can voice their views, the Lawgrove shall be the legislative assembly of Sky Haven where all citizens can present, critique, or vote on legislation.

The Keeper of the Grove

LG-II. The Keeper of the Lawgrove shall preside over discussions in the Lawgrove.
LG-III. The Keeper shall be tasked with administering votes within the Lawgrove and maintaining the regional law archive.
LG-IV. The position of Keeper shall be up for election every forty-five (45) days.
LG-V. In the event of a vacancy for reasons other than the expiration of the term in the position of the Keeper, the Demiurge shall administer a special election.

Powers of the Lawgrove

LG-VI. The Lawgrove shall have the power to create laws on all matters pertaining to the governance of the region through a simple majority vote.
LG-VII. The Lawgrove shall have the power to remove the Keeper, any member of the Domus, or Magistrate through a two-thirds majority vote.
LG-VIII. The Lawgrove shall have the power to repeal declarations of war, effectively terminating action against the target of the declaration of war, through a two-thirds majority vote.

World Assembly

World Assembly Delegate

WA-I. The World Assembly Delegate shall have the obligation to vote on World Assembly proposals as necessary.
WA-II. The World Assembly Delegate’s vote shall be determined by a public vote of the Citizens in the region.
WA-III. In the circumstance that the Demiurge’s nation has ceased to exist, or that the Demiurge is otherwise unable to secure the region, the Delegate shall assume that duty.
WA-IV. The World Assembly Delegate shall be appointed by the Majordomo subject to Lawgrove approval by simple majority vote.
WA-V. In the event of a vacancy in the position of the World Assembly Delegate, the Majordomo shall appoint a replacement, subject to Lawgrove approval through a simple majority vote.

Magistracy

The Magistrates

MA-I. The Magistracy shall be the highest judicial authority of Sky Haven.
MA-II. The Magistracy shall be comprised of three Magistrates, of which one shall have the distinction of being Archmagistrate.
(I) The Magistracy will select an Archmagistrate among themselves, subject to internal procedures.
MA-III. The Magistrates shall be nominated by the Majordomo every ninety (90) days, subject to Lawgrove approval by a simple majority vote.
MA-IV. In the event of a vacancy for reasons other than the expiration of the term in the position of a Magistrate, the Majordomo shall appoint a replacement to serve out the remainder of the term, subject to Lawgrove approval by a simple majority vote.

The Archmagistrate

MA-V. In the event of a vacancy for reasons other than the expiration of the term in the position of the Archmagistrate, the Magistrates will promote one amongst themselves to the position, subject to internal procedures.
MA-VII. The Archmagistrate shall be responsible for handling administrative matters of the Magistracy.

Powers of the Magistrate

MA-VII. The Magistracy shall have jurisdiction over matters relating to Sky Haven law.
MA-VIII. The Magistracy may decide its internal procedures provided they do not conflict with law.

Fundamental Rights of Citizens

FR-I. All Citizens of Sky Haven shall be endowed with these fundamental rights:
(I) The right to freedom of speech, given that it is not hateful in nature and does not violate the safety of an individual or the region.
(II) The right to freedom of assembly, given that it is not hateful in nature and does not violate the safety of an individual or the region.
(III) The right to freedom of the press, given that the material published is not hateful in nature and does not violate the safety of an individual or the region.
(IV) The right to vote in free and fair elections and on legislation during their time as a Citizen.
(V) The right to a fair trial in all criminal proceedings in which the burden of proof lies with the prosecution and the defendant is considered innocent until proven guilty.

Carta Provisions

Carta Supremacy

CA-I. The Carta Caelorum shall have the distinction of being the Supreme Law of Sky Haven and shall render any laws inconsistent with its provisions to have no force of law to the extent of the contradiction.

Interregional Agreements

CA-II. The Carta Caelorum shall supersede all interregional agreements and render any inconsistent interregional agreements to be wholly invalid and bear no force of law.
CA-III. The Majordomo may negotiate and present interregional agreements with other regions before the Lawgrove which will be ratified and bear the force of law upon a two-thirds majority vote.
CA-IV. Interregional agreements shall bear the force of law until they are no longer in force. The Lawgrove shall have the power to repeal any interregional agreement through a two-thirds majority vote.
CA-V. Interregional agreements shall supersede all statutory law and render any statutes inconsistent with its provisions to have no force of law to the extent of the contradiction.
CA-VI. Interregional agreements shall supersede later ratified interregional agreements and render any inconsistent later ratified interregional agreements to be wholly invalid and bear no force of law.

Amending Formula

CA-VII. Any amendment of the Carta Caelorum shall only be passed with a two-thirds majority by the Lawgrove.
